DMV Hearings

Most people do not realize that after being charged with DUI in Colorado, they will have to undergo two completely separate hearings.  The first is the criminal proceeding in which guilt for the offense will be determined by a judge, while the second is a hearing concerning the suspension of the person’s driver’s license.  After being arrested and charged with DUI in Colorado, you have only 7 days to request a DMV hearing, otherwise your driving privileges will be automatically suspended.  It is imperative that you have representation from an experienced DUI lawyer because they will be a great help to you during the DMV hearing and will improve your chances of retaining your driving privileges. 

DMV hearings are held at the Department of Motor Vehicles and are similar to trials in the respect that people will testify and evidence will be examined.  The arresting police officer will attempt to prove that there was probable cause to pull you over and arrest you, that the breath or blood sample was legally obtained, that the blood or breath test results were accurate, that your BAC was .08 or higher, and that you were properly informed of your rights by the officer.  If any of these factors cannot be proved, you may have a chance at keeping your driver’s license, but if the officer’s testimony is found to be credible, your driver’s license will be suspended for a period of time to be determined by your blood alcohol concentration and whether or not you have any previous DUI convictions on your record.
